A Conversation with Steve Bliss

I’m Tiffany Walters reporting for Wildomar News. Today I have the pleasure of speaking with Steve Bliss, a renowned trust attorney here in Wildomar.

Steve, thank you so much for joining me today. Can you tell our viewers a bit about what a Special Needs Trust (SNT) is and why it might be an important tool for families?

Tiffany, it’s my pleasure to be here. A Special Needs Trust is designed specifically to benefit individuals with disabilities without jeopardizing their eligibility for crucial government benefits like Supplemental Security Income (SSI) or Medi-Cal.

These programs often have strict income and asset limits, so a traditional inheritance could disqualify someone from receiving the support they need. An SNT acts as a safety net, allowing loved ones to provide for their family member with disabilities without impacting their access to essential benefits.

There are two main types of SNTs: first-party and third-party. A first-party SNT is funded with the beneficiary’s own assets, while a third-party SNT is established and funded by others, such as family members or friends. Consequently, both types ensure that the individual’s needs are met while preserving their eligibility for government assistance.

Moreover, a well-crafted SNT can provide funds for supplemental care, education, recreation, and other expenses that may not be covered by government programs. This empowers individuals with disabilities to live more fulfilling lives and participate more fully in their communities.

Have you encountered any unique challenges when setting up SNTs?

Over the years, I’ve seen firsthand how crucial a properly structured SNT can be for families facing complex situations. One instance that comes to mind involved a young woman with cerebral palsy who was incredibly talented and passionate about art.

Her family wanted to ensure she had access to the resources she needed to pursue her artistic dreams while maintaining her eligibility for SSI. We worked closely together to create a SNT that funded specialized art classes, adaptive equipment, and even exhibition opportunities for her work. Seeing her thrive creatively was truly heartwarming.

Notwithstanding these successes, navigating the complexities of government regulations can sometimes be challenging. It’s vital to have a deep understanding of both trust law and disability benefits programs to craft an SNT that meets the individual’s specific needs while complying with all applicable rules.

What advice would you give to families considering an SNT?

My advice is simple: seek professional guidance early on. An experienced trust attorney can help you navigate the intricacies of SNTs and ensure that the plan is tailored to your loved one’s unique circumstances.

According to a recent study by the National Disability Rights Network, over 50% of individuals with disabilities experience financial hardship due to limited access to resources.

An SNT can be a powerful tool for bridging that gap and empowering individuals with disabilities to lead more independent and fulfilling lives. I encourage anyone considering this option to schedule a consultation with a qualified attorney.
