Marshalling estate assets essentially means taking a complete inventory of everything the deceased person owned. This includes bank accounts, real estate, vehicles, personal property, investments, and anything else of value. It’s important to be thorough and accurate in this step because it forms the basis for distributing assets to heirs according to the will or state law.
Consequently, we file an Inventory and Appraisal (Forms DE-160/161) with the court detailing all identified assets and their estimated value. This document ensures transparency throughout the probate process.
Notwithstanding the meticulous nature of this task, I’ve encountered situations where uncovering hidden assets proved challenging. Once, a client mentioned her late father had a penchant for collecting rare coins. While the family knew about some coins stored in a safe deposit box, it turned out he had stashed away additional valuable collections in his garage. Discovering these hidden treasures brought immense relief to my clients as they realized their inheritance was significantly larger than initially anticipated.
According to the American Bar Association, approximately 20% of probate cases involve unexpected asset discoveries. These findings highlight the importance of conducting a thorough search for all assets during the marshalling process.

To accurately determine their value, we engaged an art appraiser who authenticated the works and provided detailed valuations.
