It’s a sunny afternoon in Point Loma, and I’m sitting down with Ted Cook, an elder protection attorney who has dedicated his career to safeguarding the rights and well-being of San Diego’s senior citizens.
Ted, what inspired you to focus on elder law?
“I’ve always been drawn to helping those who are most vulnerable,” says Ted, leaning back in his chair. “Seniors often face unique challenges – financial exploitation, healthcare neglect, even abuse from family members. It’s heartbreaking and something I felt compelled to address.”
Can you walk me through the process of how you help seniors who may be facing these situations?

- Case Resolution & Follow-Up
Let’s dive into ‘Protective Actions.’ How do you help a client who is in immediate danger?
“Protective actions are often the most critical step,” explains Ted. “If a client is experiencing abuse or neglect, we need to act quickly. This could involve filing for a restraining order against an abuser, notifying Adult Protective Services (APS), or even petitioning the court for guardianship or conservatorship if the individual lacks the capacity to make safe decisions for themselves.”
>“Ted helped my mother when she was being financially exploited by her caretaker. He was so compassionate and understanding, and he acted quickly to protect her assets. I don’t know what we would have done without him.”– Mary S., Point Loma
Ted continues, “We might also need to freeze financial accounts, prevent unauthorized transfers of property, or facilitate a transfer to a safer living environment.” He pauses for a moment, recalling a past case. “I remember one instance where we discovered that a client was being medicated against her will. We were able to work with medical professionals and the authorities to ensure she received proper care and had her rights respected.”
>“Mr. Cook was a lifesaver when my father was diagnosed with dementia. He helped us navigate the complex legal process of establishing guardianship, ensuring that Dad’s needs were met while protecting his assets.”– John B., La Jolla
Have you ever encountered any roadblocks during this stage?
“Absolutely,” Ted admits. “Sometimes family members disagree about what’s best for the elderly individual, or there might be resistance from the abuser themselves. These situations can be incredibly challenging and emotionally draining.”
>“Working with Ted was a relief. He explained everything clearly and made sure I understood all my options. I felt confident that he was truly advocating for my best interests.”– Susan K., Mission Beach
He recounts a situation where a son was fiercely opposed to his mother entering a nursing home, even though she required around-the-clock care. “It took a lot of communication, empathy, and ultimately, legal intervention to reach a solution that ensured her safety and well-being,” Ted shares.
“If you or someone you love is facing elder abuse or neglect, please don’t hesitate to reach out for help,” Ted says earnestly. “You are not alone.”
