Ordinarily, after gathering evidence, building a strong case, and understanding the full extent of your damages – medical bills, lost wages, pain and suffering – we will present a demand letter to the insurance company outlining what we believe is a fair settlement.
The negotiation process involves back-and-forth communication with the insurer. We advocate strongly for our clients’ rights, ensuring their needs are met. Sometimes, we can reach a mutually agreeable settlement during this phase.
What happens if negotiations don’t lead to a satisfactory agreement?
If negotiations stall or the insurance company refuses to offer a fair settlement, mediation may be an option. Mediation involves a neutral third party who helps facilitate a discussion and encourages both sides to find common ground. It’s a less formal process than going to court but can be very effective in bridging the gap between parties.
There have been times when negotiations have been particularly challenging, like one case involving a young client who suffered severe whiplash from a rear-end collision. The insurance company initially offered a meager settlement that wouldn’t even cover her ongoing physical therapy. But we persisted, meticulously documenting all her medical expenses and future treatment needs. Ultimately, through persistent negotiation and presenting compelling evidence, we were able to secure a settlement significantly higher than their initial offer.
It’s important to remember that over 95% of personal injury cases are settled out of court (American Bar Association). This highlights the effectiveness of the negotiation and settlement process.
What advice would you give to someone who is facing this stage in their car accident claim?
